Overview The Intra-Company Transfer (ICT) program allows international companies to temporarily transfer qualified employees to their Canadian branches without needing a Labour Market Impact Assessment (LMIA). This initiative supports Canada’s efforts to attract skilled workers and foster business growth.
 

Eligibility Criteria
 

1. Eligible Companies:

  • Must have a qualifying relationship with a Canadian enterprise (e.g., parent company, branch, subsidiary, or affiliate).

  • Must be actively engaged in business in both the home country and Canada (not just on paper).
     

2. Eligible Employees:
 

  • Must have worked continuously for the foreign enterprise outside Canada in a similar full-time position for at least one year in the last three years.

  • Must seek to perform similar duties in Canada.

  • Must hold a managerial, executive, or specialized knowledge role.
     

Types of Positions
 

1. Executives:
 

  • Direct the management of the enterprise or a major component.

  • Have wide discretionary decision-making powers.
     

2. Senior Managers:
 

  • Manage the enterprise or a department within the enterprise.

  • Supervise and control the work of other managers or professional employees.

  • Have the authority to hire and fire or recommend such actions.
     

3. Specialized Knowledge Workers:
 

  • Possess advanced expertise and proprietary knowledge essential to the enterprise’s operations.
     

Documentation Requirements
 

General Documents:
 

  • Detailed offer of employment.

  • Proof of qualifying relationship between foreign and Canadian entities (e.g., organizational charts, annual reports).
     

For Executives and Senior Managers:
 

  • Job descriptions and organizational charts detailing the position.

  • Documents showing the executive or managerial nature of the job.
     

For Specialized Knowledge Workers:
 

  • Detailed job descriptions highlighting the specialized nature of the job.

  • Proof of the employee’s qualifications and experience (e.g., resumes, degrees, certifications)


Processing Time:
 

  • Generally faster than standard work permits since an LMIA is not required.
     

Duration and Extensions
 

Initial Duration:
 

  • Executives and Senior Managers: Up to 3 years.

  • Specialized Knowledge Workers: Up to 1 year.


Extensions:
 

  • Possible if the employee continues to meet requirements and the ongoing need for their position in Canada is demonstrated.
     

Compliance and Reporting
 

  • Employers must comply with all Canadian employment laws, providing wages and working conditions that meet provincial or territorial standards.
     

  • Employers may be subject to inspections and must maintain records demonstrating compliance.
